General Assembly passes lien bill

Homebuilders in North Carolina will have to take steps to preserve their right to file a lien against a property owner if a bill OK’d be the General Assembly becomes law.

Contractors, subcontractors and suppliers will have to inform lien agents in writing whenever they begin work on a home or renovation project that costs $30,000 or more, according to Senate Bill 42, which was ratified Thursday.

Under the bill, contractors who fail to notify the lien agent for a property before they begin work will see their lien rights fall behind others in priority, meaning that if they filed a lien against the property they would likely never be paid what they are owed.

As of press deadline, Gov. Bev Perdue had not signed off on the bill.
