Comments open for proposed ADA changes Regulations could trigger spike in ADA suits

CHARLOTTE — The public has until Nov. 23 to make comments to the federal government about proposed regulations to enforce the Americans with Disabilities Act Amendment Act.

The ADAAA broadens the definition of disability so ADA cases will focus more on accommodating employees’ disabilities and whether discrimination occurred rather than on whether someone is considered disabled under the law.

It could still be months before the regs go into effect. But local labor lawyers say business owners could expect to see a spike in ADA litigation and an increase in the size of settlements as more cases go before juries.

Businesses with fewer than 15 employees are not covered under the law.
